You’ll see “How do you wish to testify?” Click “Submit Written Testimony”. Then on next screen click “By Committee and Hearing”. Then, under Committee Name, pull down and select the committee your bill is about to be heard at. Then the Meeting Date and Time. Then, under Hearing Item, you’ll see your bill, and pull down to select it. Then you’ll see an easy form to write your email! Remember to click the blue “Sign Me Up” button at the bottom. You might be asked for a few more details, then click “submit”. What’s great is that your email is within the General Assembly system, it automatically is sent to all committee members (no need to do multiple cut & paste into your own email client, etc.), and your email is a part of the public record, as is all testimony and emails to our legislators.

Concerning limitations on the ability of an employer to take an adverse action against an employee based on the employee’s use of marijuana.
BILL SUMMARY: The bill prohibits an employer from taking adverse action against an employee, including an applicant for employment, who engages in the use of:
• Medical marijuana on the premises of the employer during working hours; or
• Retail or medical marijuana off the premises of the employer during nonworking hours.
An employer is permitted to impose restrictions on employee use of medical or retail marijuana under specified circumstances.

Concerning the authority to carry a handgun.

BILL SUMMARY: The bill grants a person who is at least 21 years old and permitted to possess a handgun pursuant to federal and state law the same authority to carry a concealed handgun as a person who holds a permit to carry a concealed handgun (permit). A person who carries a concealed handgun without a permit has the same rights, limitations, and authority to carry as a person who holds a permit. A person may obtain a permit for the purpose of using the permit to carry a concealed handgun in another state that recognizes a Colorado permit. Under existing law, a permit is valid for 5 years. The bill makes a permit valid for the life of the permit holder.
HB22-1065 Emergency Mental Health Treatment And Evaluation Standard
Concerning the standard for emergency mental health treatment and evaluation.
BILL SUMMARY: Legislative Oversight Committee Concerning the Treatment of Persons with Mental Health Disorders in the Criminal and Juvenile Justice Systems. The bill changes the standard for an emergency 72-hour mental health commitment for treatment and evaluation to include when a person appears to have a mental health disorder or be gravely disabled and, as a result of such mental health disorder or being gravely disabled, appears to present an imminent or substantial risk of harm to self or others. “Substantial risk” is defined.

HB22-1155 In-state Tuition For Colorado High School Graduates
Concerning in-state tuition classification at institutions of higher education for students who complete high school in Colorado.
BILL SUMMARY: The bill repeals the requirements that a student has attended a Colorado high school for 3 years and be admitted to college within 12 months of graduating or completing an equivalency examination.
The bill requires an institution to classify a student as an in-state student for tuition purposes if the student:
• Graduated from a Colorado high school or successfully completed a high school equivalency examination in Colorado; and Has resided in Colorado for at least 12 consecutive months prior to enrolling in an institution. Because the bill repeals the requirement to be admitted to college within 12 months of graduation, the bill also repeals the exception to that requirement for a student who does not have lawful immigration status and graduated or successfully completed the equivalency examination prior to September 1, 2013.
• Has resided in Colorado for at least 12 consecutive months prior to enrolling in an institution.

HB22-1206 Prohibit Discriminatory Practices In Schools (questions about this bill!)
Concerning prohibiting discriminatory practices in public schools.
BILL SUMMARY: The bill prohibits teaching or using instructional materials at public schools that promote discrimination.
The bill prohibits public schools from certain discriminatory practices based on a student’s, student’s family, or teacher’s race or ethnicity.
The bill creates a $25,000 fine to be paid by the school district of the public school, or by the state charter school institute in the case of an institute charter school, to the state education fund if the commissioner of education finds that a public school knowingly violates a prohibition. The bill waives sovereign immunity and creates a civil action against a public school and the school district or board of cooperative services or the state charter school institute that violates a prohibition.

BILL SUMMARY: The bill specifies that air-source and ground-source heat pump systems are household furnishings exempt from the levy and collection of property tax. The bill exempts air-source and ground-source heat pump systems from the definition of “fixtures” for property tax purposes. Beginning July 1, 2024, the bill exempts from state sales and use tax all sales, storage, and use of eligible decarbonizing building materials. “Eligible decarbonizing building materials” are defined as building materials that have a maximum acceptable global warming potential as determined by the office of the state architect.

Concerning improving access to health benefits for economically insecure Colorado families by enhancing public health programs.
BILL SUMMARY: The bill makes the following changes to health insurance coverage for low-income pregnant people and children in low-income families:
• Provides full health insurance coverage for Colorado pregnant people who would be eligible for medicaid and the children’s basic health plan (CHIP) if not for their immigration status and continues that coverage for 12 months postpartum at the CHIP federal matching rate;
• Provides comprehensive health insurance coverage to all Colorado children who would be eligible for medicaid and CHIP if not for their immigration status; • Requires the state department of health care policy and financing to create an outreach and enrollment strategy for enrolling eligible groups into new coverage options;
• Makes comprehensive lactation supports and supplies, including breast pumps, a covered benefit for perinatal people on medicaid and CHIP;
• Draws down federal funds to improve perinatal and postpartum support and requires that priorities for the funds be determined through a stakeholder process;
• Permanently authorizes an existing survey of birthing parents, run by the state department of public health and environment and increases the ability of the survey to collect and report on the experiences of birthing people of color in Colorado;
• Creates a special enrollment period for health insurance coverage due to pregnancy so that an eligible person can sign up for insurance as soon as the person becomes pregnant; and
• Improves the quality of health insurance coverage available through the health insurance affordability enterprise.

BILL SUMMARY: The bill establishes a parent’s bill of rights that sets forth specific parental rights related to directing the upbringing, education, and health care of a minor child. The bill requires a board of education of a school district, board of cooperative services,
charter school, or institute charter school, in consultation with parents, teachers, and administrators, to develop and adopt a policy to promote the involvement of parents of the enrolled minor child. The bill prohibits an individual, corporation, association, organization, state-supported institution, or individual employed by any of these entities from procuring, soliciting to perform, arranging for the performance of, or performing a surgical procedure upon a minor without written or verbal consent from the minor’s parent. Parental consent is not required if the minor is in the custody of a county department of human or social services or the division of youth services.

The bill requires the department of health care policy and financing (department) to prepare a report of medicaid reimbursement rates for community mental health providers and independent mental health and substance use treatment providers. The department must hire an independent auditor to prepare the report and provide recommendations on the report to be presented to the house of representatives public and behavioral health and human services committee. The department is required to prepare recommendations based on the audit findings and recommendations to create equitable payment models between providers of community mental health centers and independent mental health and substance use treatment providers providing comparable behavioral health services.
